ICJ Genocide Case Update — Who Intervened, and on Which Side

During the week of 12 March 2026, the United States, Hungary, Namibia and Fiji each filed Declarations of Intervention at the International Court of Justice in South Africa’s genocide case against Israel — taking opposing sides.

The positions filed

United States — intervened rejecting the allegations of genocide. Its eleven-page submission described the accusations as false and argued that Israel has no intent to destroy the Palestinian people, and that civilian casualties in urban warfare do not constitute genocidal intent.

Hungary — intervened in support of Israel, maintaining that the high threshold for inferring genocidal intent from surrounding circumstances has not been met.

Fiji — intervened in support of Israel, stating that it was addressing legal questions on the interpretation of the Genocide Convention, particularly regarding combatants embedded within civilian infrastructure.

Namibia — intervened backing South Africa, arguing that the scale, systematic nature and intensity of the acts — including forced displacement and starvation — are evidence of potential genocidal intent.

All were made under Article 63 of the ICJ Statute, which allows third states to put their interpretation of the Convention. They followed interventions by the Netherlands and Iceland earlier the same week, both supporting the allegations.

Why that week mattered

Israel was scheduled to file its counter-memorial around 13 March 2026, after a series of extensions. The original deadline was July 2025; an extension was sought and, over South Africa’s opposition, granted to January 2026; a further five-month extension was sought and granted to 12 March 2026.

As at the time of writing there was no indication, from the Court or from Israel, that a submission had been made that week.
